§ 1 Scope
The following General Terms and Conditions in their version valid at the time of the order apply exclusively to the business relationship between bikeroutfit.at and the customer. bikeroutfit.at does not recognise any deviating conditions of the customer unless bikeroutfit.at has expressly agreed to their validity in writing.

§ 2 Conclusion of contract
Your order represents an offer to us to conclude a purchase contract. A purchase contract is only concluded when your payment has been received by us (you have the choice between advance payment via bank transfer or payment by credit card via PayPal).
when we send the ordered product to you and confirm the dispatch to you with a second e-mail (shipping confirmation). No purchase contract is concluded for products from one and the same order that are not listed in the shipping confirmation. The contractual partner is bikeroutfit.at.
bikeroutfit.at does not offer products for purchase by minors. Even our products for children can only be purchased by adults.
Please note that we only sell all products in quantities customary for households.

§ 3 Withdrawal
You can revoke your declaration of contract within two weeks without giving reasons in text form (e.g. by letter or e-mail) or by returning the item. The period begins with the receipt of the goods and not before receipt of this instruction. To comply with the withdrawal period, the timely dispatch of the revocation or the item is sufficient. Consequences of withdrawal:
In the event of an effective withdrawal, the services received by both parties must be returned and any benefits derived (e.g. interest) must be surrendered. If you are unable to return the received service in whole or in part, or only in a deteriorated condition, you may have to pay compensation in this respect. This does not apply to the surrender of items if the deterioration of the item is exclusively due to its inspection - as would have been possible for you in a retail shop.
Otherwise, you can avoid the obligation to pay compensation for value by not using the item as an owner and refraining from anything that impairs its value.
In the case of a return within 14 days, you must bear the costs of the return if the delivered goods correspond to the ordered goods. Otherwise, the return within 14 days is free of charge for you.

§ 4 Delivery
Unless otherwise agreed, delivery will be made from the bikeroutfit.at warehouse to the delivery address specified by the customer. Information about the delivery period is non-binding, unless the delivery date has been expressly agreed as binding in exceptional cases.
If bikeroutfit.at is unable to deliver the ordered goods through no fault of its own because the supplier of bikeroutfit.at does not fulfil its contractual obligations, bikeroutfit.at is entitled to withdraw from the contract with the customer. In this case, the customer will be informed immediately that the ordered product is not available. The customer's statutory claims remain unaffected.
If delivery to the customer is not possible because the customer is not found at the delivery address provided by him, although the delivery time was announced to the customer with a reasonable deadline, the customer bears the costs for the unsuccessful delivery.

§ 5 Due date and payment, default
The customer can pay the purchase price by advance payment or with his credit card (via PayPal). If the customer is in default of payment, bikeroutfit.at is entitled to demand default interest at a rate of 5% above the base interest rate per annum announced by the European Central Bank. If bikeroutfit.at has demonstrably incurred higher damages due to default, bikeroutfit.at is entitled to claim these.

§ 6 Offsetting, retention
The customer is only entitled to offset if his counterclaims have been legally established or are undisputed by bikeroutfit.at. Furthermore, he is only entitled to exercise a right of retention insofar as his counterclaim is based on the same contractual relationship.

§ 7 Retention of title
The delivered goods remain the property of bikeroutfit.at until full payment.

§ 8 Liability for defects
If there is a defect in the purchased item, the statutory provisions apply. The assignment of these claims by the customer is excluded.
Unless otherwise stated below, further claims of the customer - for whatever legal reasons - are excluded. bikeroutfit.at is therefore not liable for damages that have not occurred to the delivery item itself; in particular, bikeroutfit.at is not liable for lost profits or for other financial losses of the customer. Insofar as the contractual liability of bikeroutfit.at is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents.
The foregoing limitation of liability does not apply if the cause of damage is based on intent or gross negligence or if there is personal injury. It also does not apply if the customer asserts legally regulated claims.
If bikeroutfit.at negligently breaches a material contractual obligation, the obligation to compensate for property damage is limited to the typically arising damage.
If supplementary performance has been carried out by way of replacement delivery, the customer is obliged to return the goods delivered first to bikeroutfit.at at the expense of bikeroutfit.at within 30 days. The return of the defective goods must take place in accordance with the statutory provisions. bikeroutfit.at reserves the right to claim damages under the legally regulated conditions.
The limitation period is twelve months, calculated from delivery.

§ 9 Collection, processing and use of personal information of our customers
Information we receive from you helps us to personalise and constantly improve your shopping experience at bikeroutfit.at. We use this information for processing orders, delivering goods and providing services, as well as processing payments. We also use your information to communicate with you about orders, products, services and marketing offers, as well as to update our records and maintain and manage your customer accounts with us. We also use your information to improve our platform, to prevent or detect abuse of our website, or to enable third parties to perform technical, logistical or other services on our behalf.
Further information about the type, scope, location and purpose of the collection, processing and use of personal data required for the execution of orders, registration for the e-mail notification service, the submission of an online review by bikeroutfit.at can be found in the data protection declaration.

§ 10 Applicable Law
Austrian law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Innsbruck.

Payment by invoice and financing

In cooperation with Klarna we offer you invoice purchase and instalment purchase as payment options. Please note that invoice purchase and instalment purchase are only available to consumers and that payment must be made to Klarna in each case.

Invoice

When buying on account with Klarna, you always receive the goods first and you always have a payment period of 14 days. The online shop charges a fee of 0 euros per order for invoice purchases with Klarna.

Instalment purchase

With Klarna's financing service, you can pay for your purchase flexibly in monthly instalments of at least 1/24 of the total amount (but at least €6.95). Further information on instalment purchase, including the general terms and conditions and the European standard information for consumer credit, can be found here. Instalment purchase is only offered for Germany.

Data protection notice

Klarna checks and evaluates your data and, if there is a legitimate interest and occasion, exchanges data with other companies and credit agencies. Your personal data will be treated in accordance with the applicable data protection regulations and according to the information in Klarna's data protection regulations for Germany / Austria .
